Hunsaker & Moske Fighting for Clients’ Right to a Fair Trial in a Dental Malpractice Case

St. Louis Office Managing Partner Richard Hunsaker and Of Counsel Attorney Karen Moske of Heyl Royster are fighting for their clients’ right to a fair trial in a dental malpractice case. This week, Hunsaker and Moske filed a motion to vacate a judge substitution order, arguing that the plaintiff engaged in inappropriate judicial forum shopping by dismissing the complaint prior to trial, refiling it, and then seeking a new judge. Hunsaker cites Illinois Supreme Court precedent in support of his argument and asserts that his clients were deprived of their right to object. The cited Illinois Supreme Court authority involves a case handled by Heyl Royster in Jefferson County in 2016. A case management conference is set for May 2.
