Benfield and Monfort Obtain Summary Judgment for Healthcare Provider

Heyl Royster's Mark Benfield and Renee Monfort recently obtained summary judgment in a medical malpractice case. The plaintiff filed suit against a central Illinois provider and her practice group, alleging that negligent therapy caused a back injury resulting in significant pain, impairment, and an inability to work. The allegations included failure to assess the patient properly, failure to supervise therapy, improper use of mechanical traction, and failure to follow the manufacturer's instructions/warnings. Mark and Renee strategically positioned the case through expert discovery, ultimately securing judgment in favor of the defendants on all counts. The victory comes on the heels of the duo's February defense verdict.
